Terms of Service

These Terms of Service (“Terms”) govern your use of the websites operated by Heartland Flood & Mold Restoration LLC (“Heartland,” “we,” “us,” or “our”), including heartlandflood.com and any associated landing pages, as well as any service request you submit through those websites. By visiting the site or submitting a contact form, you agree to these Terms.
1. Description of Services
Heartland is a Kansas-licensed restoration company serving the Kansas City metro. We provide water damage restoration, mold remediation, sewage cleanup, storm damage cleanup, emergency response, and related haul-away services. All work is performed by IICRC-certified technicians under a separate written services agreement signed between you and Heartland after a property assessment.
2. No Service Until a Written Agreement Is Signed
Submitting a contact form, requesting a quote, or speaking with a dispatcher does not create a binding services contract. A binding obligation to perform restoration work arises only when Heartland and the property owner (or an authorized representative) sign a written services agreement that describes the scope, price, and terms of that specific project.
3. Estimates and Pricing
Preliminary phone or on-site estimates are provided in good faith based on observed conditions. Final pricing depends on the conditions our crew encounters during the work, including hidden damage, materials affected, and the scope of mitigation required. Where Heartland has signed a written estimate or services agreement, that document controls over any earlier verbal or written estimate.
4. Insurance and Claim Documentation
Heartland does not file, negotiate, or settle insurance claims on your behalf. Your insurance policy is a contract between you and your insurance carrier, and any claim is your responsibility to file and manage. What Heartland provides is detailed, adjuster-ready documentation of the damage and our mitigation work - including photos, moisture readings, scope sheets, and IICRC-aligned reports - and we will answer reasonable questions from your adjuster about our findings if you authorize us to do so.
You remain responsible for payment of Heartland's invoices regardless of whether your insurance carrier approves, denies, or partially pays your claim. Your insurance policy is a reimbursement contract with your carrier, not a payment agreement between Heartland and your carrier.
5. Property Access and Authorization
By scheduling or accepting service from Heartland, you confirm that you own the property or are authorized by the owner to authorize the work. You grant Heartland and our crew reasonable access to the affected areas, the ability to set up drying and containment equipment, and permission to take photographs and moisture readings necessary to document the work.
6. Payment Terms
Payment terms are set in the written services agreement for each project. Unless otherwise agreed in writing, invoices are due on completion. Late balances may accrue interest at the maximum rate allowed by Kansas law. If collection is required, you agree to pay reasonable costs of collection, including attorney's fees.
7. User Responsibilities
You agree that:
- The information you submit through our forms is accurate.
- You will not use our website or services for unlawful purposes.
- You will not attempt to interfere with the operation of our website.
- You will not misrepresent your identity or authority to authorize work on a property.
8. Intellectual Property
All content on our websites - including text, photos, logos, graphics, and the underlying code - is owned by Heartland or licensed to us. You may not copy, reproduce, or republish our content without written permission, except for personal, non-commercial use.
9. Disclaimers
Our websites and the information on them are provided “as is” without warranties of any kind, either express or implied. Heartland does not warrant that the websites will be uninterrupted, error-free, or free of viruses or other harmful components. Cost ranges, timelines, and other figures shown on our websites are typical examples and are not guaranteed for any specific project.
10. Limitation of Liability
To the maximum extent allowed by law, Heartland's total liability arising out of or related to your use of our websites is limited to the greater of $100 or the amount you paid Heartland in the prior 12 months. Heartland is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages. This section does not limit liability for our negligence in performing restoration work, which is governed by the separate signed services agreement and applicable Kansas law.
11. Indemnification
You agree to indemnify and hold Heartland harmless from any claim, loss, or expense (including reasonable attorney's fees) arising from your breach of these Terms, your misuse of the websites, or your misrepresentation of facts in a service request.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules. Any dispute arising under these Terms must be brought in the state or federal courts located in Johnson County, Kansas, and you consent to the personal jurisdiction of those courts.
13. Dispute Resolution
Before filing a lawsuit, the parties agree to attempt to resolve any dispute in good faith through informal discussion. If that fails, either party may submit the dispute to non-binding mediation in Kansas City before filing suit, unless emergency or injunctive relief is needed.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be posted prominently on the websites. Continued use of the websites after changes take effect constitutes acceptance of the revised Terms.
15. Termination
Heartland may suspend or terminate your access to our websites at any time for any reason. Sections of these Terms that by their nature should survive termination (including limitation of liability, indemnification, governing law, and intellectual property) will survive.
